For 3CU, growing our presence in the Gulf region has been a top priority since our inception. And to build on the success we’ve achieved there, we recently announced plans to expand into Oklahoma. To help us accomplish this strategy successfully, we’re excited to announce the hiring of Michael Gallien, who will serve as a new underwriting resource for the states of Texas and Oklahoma.
Based in San Antonio, Texas, Michael brings nine years of experience in the insurance industry, including years of experience as a producer and case manager in addition to his experience as an underwriter. This broad experience gives him a well-rounded understanding of the industry and a strong record of building and maintaining relationships.
Together with Business Development Regional Director Bob Hamilton, Loss Control Manager David Brandolino, Senior Business Development Specialist Johnny Clebert, Senior Loss Control Specialist Mike Humble, and Senior Claims Representative Kristin Shortess, this team will help 3CU penetrate into these key states even further with their on-the-ground presence. We look forward to continued growth and development of relationships with new agents and customers in these areas, while we continue to deliver exceptional outcomes and service to our clients.
When an injury occurs, our goal is to make the claim reporting and handling process as easy and efficient as possible for policyholders. Because we’re committed to quick resolutions, we offer an electronic First Notice of Loss (“FNOL”) reporting form on our securepolicyholder website. Utilizing this form provides ease for our customers by automatically uploading their company information and accelerates the claims process by immediately notifying the claims examiner.
We encourage you to inform your Third Coast Underwriters customers of this functionality so they know the most expedient way to report a claim, should an accident or injury occur. If they don’t know how to log into our secure policyholder site, they should contact their Loss Control Consultant or our Help Desk at 866-641-2328.
Life is busy and so are your clients. We’d like to bring risk management to the forefront of their busy minds through our new quarterly Claims Dashboard reports. Emailed quarterly, these reports will highlight items we’ve noticed as key indicators for risk management, such as:
- Claims and loss performance data
- Claims greater than 10K
- Top causes of loss
- Report lag time
As a reminder, this information is always available to you and to your policyholder through our RMIS 411 system. While some customers use RMIS very regularly, they’re in the minority. By providing a quarterly snapshot in their inbox, we hope to increase the number of policyholders using this great system, or at a minimum, put the most pertinent information in front of them so they are able to see a quick snapshot of risk management data – before they become large issues and losses.
We will be sending the first set of Claims Dashboards to you in the mail in advance of sending these to policyholders; to ensure you are in-the-know with your clients should they have any questions. We think this is a great value-added to show our commitment to great claims, loss control and keeping our promises in being a true partner in risk management.

NCOIL Panel to Examine Workers’ Compensation Opt-Out Approaches
The National Conference of Insurance Legislators’ (NCOIL) Workers’ Compensation Insurance Committee has decided to investigate workers’ compensation opt-in/opt-out approaches in Texas and Oklahoma, which are being considered by other state lawmakers. Panel Chair and North Dakota State Senator Tom Klein said that the Texas and Oklahoma systems raise questions about protections for injured workers. As previously communicated, Accident Fund Holdings, Inc. will oppose opt-out initiatives wherever introduced. We feel opt-out systems put injured worker quality of care at risk as well as initiate cost shifting to federal and state programs.

Workers’ Compensation Litigation
Of related interest is the recent Folta v. Ferro Engineering decision by the Illinois Supreme Court. This decision overturned an adverse appellate court decision and sustained the exclusive remedy doctrine where the employee was time-bared from asserting a claim under Illinois’ occupational disease statute, even though the disease did not manifest until after the right to bring an action had expired. Although the majority of the court, in its 4-2 decision, recognized the harsh result to a survivor of an employee, now deceased, unable to recover only because his occupational disease did not manifest during the 25-year statute of repose, it validated the policy of such a provision by providing some degree of certainty to liability exposure for long-latency diseases. We should expect legislation that would reverse the effect of this decision to be introduced into the legislature in 2016.
Workers’ Compensation Legislative Update
There has been little substantive progress in the standoff between Governor Bruce Rauner (R) and Democrat legislators over resolution of the state’s budget and related business reforms. The industry remains engaged with staff from the governor’s office and legislators; continuing to recommend prescription drug reforms, a Medicare-based fee schedule and chiropractic care reforms.
