President Marguerite Dixen Reflects on 5 Years of Success for 3CU

Dixen_MargueriteOn July 1, 2010, Third Coast Underwriters opened for business with one purpose – to provide a truly unique workers’ compensation solution for insureds and agents with complex exposures and service needs. Five years later, our mission remains the same but we’ve grown into a respected, recognized brand in the marketplace that delivers what we promise to our agents and customers. In honor of our fifth anniversary, I wanted to share with you the five things I’m most proud we’ve accomplished in these last few years.

  • Building a team of dedicated, expert professionals: 3CU couldn’t achieve the success we’ve had without gathering some of the most talented professionals I have ever had the pleasure to work with. We’ve assembled some of the most experienced people in the work comp industry who understand the niche industries that we specialize in and are committed to using their expertise to the benefit of our customers.
  • Developing a reputation for excellent service: Our customers repeatedly tell us that our commitment to excellent service differentiates us from our competitors. Because of this, we have become known for delivering exceptional outcomes. We work tirelessly to assist our customers in keeping their employees safe, their injured workers cared for, and their costs manageable.
  • Establish a record of keeping promises: At 3CU, our core value is keeping our word – to our customers, our agents and each other. By developing this trust, we’ve established relationships that have allowed us to grow our business substantially, expand our regional footprint and plan for future success.
  • Achieving profitable results: Through careful underwriting, superior loss control, exceptional claims handling and active book management, 3CU has achieved and maintained post-startup profitability. 3CU’s current results are the best I’ve personally experienced during my time in the industry, a testament to the daily efforts put forth by our team to remain focused on our core competencies.

The scale of the organization allows us the economy of scale needed to remain competitive, while keeping 3CU focused on the needs of our individual clients.

I’m excited to celebrate our fifth anniversary and the expansion of 3CU’s Chicago headquarters in late July. We have a beautiful space from which to continue on this journey as 3CU evolves into one of the premier specialty workers’ compensation providers in the country. Return to Work Helps Severely Injured Claimant Return to Full Duty, Brings Savings for Insured

Ambulance-EMS-gourneyAvoiding what could have resulted in a catastrophic loss, the efforts of the 3CU team and the effective use of return to work helped bring a young worker back to full duty just six months after a severe work injury. The claim involved a highway construction worker who was severely injured after becoming pinned between a concrete barrier and an excavator in early August last year. To help facilitate the claim, 3CU assigned a nurse case manager who worked with the man, his parents and eventually his attorney to understand and navigate his recovery process.

While the claimant was recovering, 3CU Senior Claim Representative Stephanie Bolen was also working closely with the insured. “I explained to them that if he didn’t return to work in some capacity, he may get into that disability mode and possibly never return,” Bolen said. The potential exposure could result in the payment of years of wage differential benefits. Bolen educated the insured on the negative implications to their experience modification factor and what that could mean to future premiums and business opportunities. The insured was very receptive to her feedback and supportive of developing short term light-duty opportunities as well as long-range alternatives, if the claimant would have permanent restrictions placed on the type of work he could do.

By early December, the claimant was released for light duty and began working half days. By February, he was released to full duty and back to doing his normal job – a remarkable achievement given the severity of his injuries a little more than 6 months earlier. Bolen is convinced 3CU’s consultative approach with all parties involved and the effective use of return to work made all the difference. “Had we not explained the benefits of providing light duty work options, had the insured not brought him back and worked with us, and had the claimant not been receptive to our efforts, he would have likely been off the job a lot longer and possibly never returned,” Bolen said. “It could easily have turned into a catastrophic loss.”

Most important, it’s satisfying to know that our collaborative efforts helped return a young worker to his job and to a full and productive life.

New Hires Show 3CU’s Commitment to the Southeast

Business-People-SmilingAs part of our regional growth strategy, 3CU has been focused on increasing our presence in the Southeast. To illustrate our commitment to this goal, we are excited to announce three recent hires who will be based throughout the region. They are:

  • Torin Durham, Senior Business Development Specialist: Based in Georgia, Torin brings 13 years of underwriting experience with specific expertise in handling high-hazard, complex accounts. He also has a strong track record of developing and fostering valued agency partnerships.
  • Greg Hurd, Senior Claims Consultant:Based in Tennessee, Greg brings nearly 18 years of workers’ compensation claims experience. He’s worked closely with multiple national accounts and has experience in more than 25 jurisdictions, including those throughout the Southeast and Gulf region.
  • Scott Oliver, Senior Loss Control Specialist: Based in North Carolina, Scott brings 23 years experience in loss control and risk management consulting. He has earned his ARM, INS and has certifications for OSHA 500: Trainer Course for Construction and as a 130 Hour Construction Safety Coordinator.

Together with Business Development Regional Director Jerry Self, Loss Control Manager David Brandolino and Senior Claims Representative Kriste Henderson, these six will help 3CU penetrate the Southeast region even further with their on-the-ground presence. And having them close and readily available to our valued agents and customers will help 3CU continue to deliver the exceptional outcomes and service they’ve come to expect.

3CU Toolbox Makes Safety Resources Just a Click Away

To access the 3CU Toolbox, go to3CU.com and click on Toolbox in the upper right hand corner of the page. On the Toolbox page, you’ll find icons that allow you to peruse materials by four topics – Claims, Fraud, Loss Control and All Resources.

  • Click on Claims to get information on how to report a claim easily as well as useful claim-related forms that you may need to process your incident efficiently.
  • Click on Fraud to learn examples of fraudulent behavior, download fraud posters and fliers, and how to report fraud easily and anonymously. (We’ll tell you here too – call 1-800-944-FRAUD (3728) or email ReportFraud@3CU.com.)

Sales Video Promotes 3CU’s Loss Control Expertise

video_still2Since our start, 3CU’s focus has been on delivering outcomes for customers with high hazard operations. That’s why we’ve assembled a team of loss control consultants who are experts in developing safety solutions for complex operations.

To help explain 3CU’s distinctive approach to loss control, we’ve developed a new sales video, “3CU Promise: Loss Control Expertise.” This 80-second video explains the assessments used in evaluating customers to ensure they have the best safety controls in place. It also details the tools and resources available to customers to improve their employees’ safety training.

Federal

Terrorism Risk Insurance Program Reauthorization Act of 2015

According to the Terrorism Risk Insurance Program Reauthorization Act of 2015 enacted in January, the U.S. Treasury and the Federal Insurance Office are required to collect insurance industry terrorism data beginning in 2016. Creating a duplicate or new data reporting process for the federal government could be cumbersome and costly for the industry. Accident Fund Holdings remains engaged with the National Council on Compensation Insurance (NCCI) and our National trade the American Insurance Association (AIA) as they work with NAIC, Treasury and the Federal Insurance Office to identify a solution to the data reporting requirements.

State

Colorado

New House Bill in Colorado – New Requirements for Employers

Effective April 1, 2015, House Bill 14-1383 was passed into law. This change in the Colorado Workers’ Compensation Act will require employers in Colorado to provide injured workers the choice of four physicians for treatment. Prior to the new law, the requirement was to provide two physicians. At least one of the four physicians must be at a separate and distinct location from the others.

If the employer location is in a rural area, and there are at least three but fewer than nine physicians within a 30-mile radius of the employer’s location, the employer is exempt from this ruling. In these instances, however, the employer must provide two physicians with separate and distinct addresses and without common ownership.

Please share this with any 3CU policyholders with Colorado exposure and direct them to 3CU for assistance in locating providers.

Illinois

Gov. Rauner Proposes Work Comp Reforms

Gov. Bruce Rauner’s “Turnaround Agenda,” which includes several positive workers’ compensation proposals, has been receiving an increased amount of discussion as of late. The Chamber of Commerce recently communicated that Rauner is really pushing for work comp reform. Rauner has told legislators that if they want any increases in taxes, etc., they need to support his economic reform first. With Democrats possessing a supermajority in the Illinois legislature, if any of the perceived positive comp legislation is to gain momentum, the governor will have to engage in serious horse trading. We intend to monitor this situation closely.

Iowa

New Law Impacts Sole Proprietors, Partners and Limited Liability Company Members

The Iowa Legislature passed a new law that will impact sole proprietors, partners and limited liability company members doing business in Iowa. The Iowa Legislature passed House File 259 to clarify sole proprietors’ intent to be covered or not be covered by a workers’ compensation policy. Iowa Workforce Development’s Division of Workers’ Compensation recently released a revised non-election of Workers’ Compensation or Employers’ Liability Coverage Form, 14-0174 (5-15). Click here for the form.

The revised form should be used for proprietors, LLC members and partners to clarify their intent to not be covered by workers’ compensation. The current workers’ compensation law has not changed. These persons are still not considered employees and are automatically excluded from coverage unless they elect inclusion. This form must now be signed to clarify their intent to not be covered. The Division has released no further instructions or information in regards to this issue only that the form has been revised. Should additional information be released, we will communicate appropriately.

Ohio

House Bill Would Allow Large Employers to Get Work Comp Coverage from Private Carriers

House Bill 205 was recently introduced and proposes to allow large employers (those with 1,000 or more employees) and “groups” to forgo obtaining workers’ compensation insurance from the Ohio Bureau of Workers’ Compensation (BWC) and instead utilize coverage from private carriers. According to the legislation, a group is defined as: An association that 1) has been organized and maintained for at least one year in good faith for purposes other than obtaining private market workers’ compensation coverage and 2) maintains a minimum enrollment of 300 employees in this state of two or more employers whose businesses are substantially similar such that the risks which are grouped are substantially homogeneous. Similar initiatives have failed in the past. We’ll continue to monitor this initiative.

South Carolina

House Legislation Would Provide Work Comp Opt-Out Provisions

House Bill 4197, the “S.C. employee injury benefit plan alternative,” would provide workers’ compensation opt-out provisions for eligible employers. This proposal is nearly identical to House Bill 4171, which was introduced back in May, with the only notable difference between the two bills being the committee to which they were referred. We anticipate this initiative will receive consideration in 2016.

Both bills were initiated by the Association for Responsible Alternatives to Workers’ Compensation (ARAWC). ARAWC’s website claims they are an organization that focuses on ensuring that employees receive the best possible care and employers have the choice to provide what is best for their employees. Similar law is in place in Oklahoma and Texas, and this year legislation was introduced in Tennessee to promote a similar initiative.

Tennessee

Opt-Out Legislation Stalls

Proposed Tennessee Opt-Out legislation, Senate Bill 721, has stalled at this time. We have confirmed the House will not address the initiative this year. The Senate sponsor and primary advocate has communicated he will continue to pursue a floor vote in the Senate. Although the legislative effort will not progress this year, we anticipate Senate Bill 721 to receive increased debate in 2016.

NCCI Named Residual Market Plan Administrator

The Tennessee Department of Commerce and Insurance (TDCI) has chosen the National Council on Compensation Insurance (NCCI) as the new plan administrator for the Tennessee Workers’ Compensation Insurance Plan (TWCIP). Beginning with policies effective July 1, 2015, NCCI will administer the plan, which will be renamed the Workers’ Compensation Insurance Plan (WCIP). NCCI will establish the infrastructure necessary to provide workers’ compensation residual market services, such as application processing and administration of the plan rules, and access to coverage in certain other states, among other services. Tennessee will join 22 other states in utilizing this national workers’ compensation residual market system. TDCI Commissioner Julie Mix McPeak welcomes the new administrator and looks forward to working with NCCI.

Texas

Governor Vetoes Bill to Create Workplace Safety Grant Program

On June 20, Gov. Greg Abbott vetoed a bill that would have created grant programs for workplace safety. House Bill 2466 would have given safety grants up to $5,000 for reimbursements to employers with two to 50 employees that incurred expenses while creating safer workplaces. Allowable expenses would have included physical modifications to worksites, safety equipment and safety training for employees. In his veto statement, Abbott said: “Texas has been doing pretty well without a safety reimbursement program run by the Department of Insurance. To stay strong, we should resist the needless growth of government even in small ways.”
